Answers to questions on social benefits in the event of job loss (SBjl) from the State Social Insurance Fund

1. Is there a standard for the provision of public services for the appointment of social benefits in case of job loss?

The public service standard "Assignment of social benefits in case of job loss" is approved by Appendix 8 to the Rules for calculating (determining), the amount of social benefits, assigning, recalculating, suspending, resuming, terminating and making social benefits from the State Social Insurance Fund and their implementation, approved by order Minister of Labor and Social Protection of the Population of the Republic of Kazakhstan dated June 8, 2020 No. 217.

2. When does the right to assign a social benefit in case of job loss (SBjl) arise?

The right to appoint a SBjl arises from the registration date of a participant in the compulsory social insurance system as an unemployed person by the employment center. 

In this regard, a participant in the compulsory social insurance system applies for registration as a job seeker through the employment center or the e-government portal (egov.kz) or the Electronic Labor Exchange portal (enbek.kz). After that, within the terms established by the legislation of the Republic of Kazakhstan on employment, he is registered as unemployed.

How long does it take to apply for a social benefit in case of job loss (SBjl)?

An application for the appointment of an SBjl is submitted: 

to the branch of the State Corporation "Government for Citizens" - if there is information about registration as unemployed         

or

in the employment center - when registering a person as unemployed and applying on the principle of "one application" for the appointment of social benefits in case of job loss

or 

through the web portal of "electronic government" (egov.kz) - if there is information about registration as unemployed

or 

through the state information portal "Electronic Labor Exchange" (enbek.kz) when registering as an unemployed person on the specified portal 

or

when registering  the telephone number of the service recipient on the e-government portal, a proactive service is provided, if the consent of the service recipient is received within 3 calendar days by SMS notification.

4. How long does it take to apply for a social benefit in case of job loss (SBjl)?

The terms for applying for the appointment of a SBjl cannot exceed 12 months from the date of registration of a participant in the compulsory social insurance system as an unemployed person by the employment center. 

5. What documents are needed to assign a social benefit in case of job loss (SBjl)?

The SBjl is appointed on the basis of the following documents:     

1) identity document (identity card, stateless person's card, residence permit of a foreigner) or repatriate (Qandas) certificate for persons with Qandas status - required for identification;

2) for residents of the city of Baikonur - a certificate from the department of accounting and registration of citizens for housing sector of the city Baikonur;

The specialist who receives the application and documents generates requests to the relevant IS through the e-government gateway:

1) in the IS State database "Individuals" on the documents proving the identity of the applicant;

2) in the IS of second-tier banks according to information about the number of a bank account opened with banks and (or) organizations carrying out certain types of banking operations, or a cash control account of a correctional institution;

3) in the IS "Labor Market" on the certificate of the authorized body for employment on the registration of the applicant as unemployed.

In case of inconsistency (absence) of information in the IS, the relevant documents are attached to the application, with the exception of information about the bank account number.

6. For what period is the social benefit in case of job loss (SBjl) assigned?

SBjl is assigned depending on the length of participation in the compulsory social insurance system (hereinafter - CSIS) for the following periods:

for 1 month - in the case when social contributions were made for the CSIS participant from 6 to 12 months;

for 2 months - in the case when social contributions were made for the CSIS participant from 12 to 24 months;

for 3 months - in the case when social contributions were made for the CSIS participant from 24 to 36 months;

for 4 months - in the case when social contributions were made for the CSIS participant from 36 to 48 months;

for 5 months - in the case when social contributions were made for the CSIS participant from 48 to 60 months;

for 6 months - in the case when social contributions were made for a CSIS participant from 60 months or more.

7. What is the term for the provision of public services for the appointment of social benefits in case of job loss (SBjl)?

The term of appointment of the SBjl does not exceed six working days from the date of registration of the application with all the necessary documents to the State Corporation "Government for Citizens" (hereinafter - State Corporation) or from the date of receipt of consent to the appointment of a SVPR through a proactive service by SMS notification from the applicant's mobile phone.   

The State Social Insurance Fund (SSIF) has the right to verify the authenticity of documents (information) necessary for the assignment of social benefits. For these purposes, the SSIF has the right to send requests to state bodies and relevant organizations, the payer of social contributions and the applicant. At the same time, the applicant is notified through the State Corporation in written and (or) electronic forms about the delay in making a decision on the appointment of the SBJL and the deadlines for extending the decision, but not more than  one  month.

8. How is the amount of the social benefit in case of job loss (SBjl) determined?

SBjl = AMI * IRR * LP

AMI - the average monthly income of a participant in the system of compulsory social insurance for the last 24 months preceding the month of registration as unemployed    

AMI = (MI1+MI2+MI3...+MI24)/24, where:

MI - monthly income taken into account as an object of calculation of social contributions (hereinafter - SC)(income minus income from which SC are not paid, including mandatory pension contributions (hereinafter - MPC)).

IRR - income replacement rate is 0.4;     

;LP- length of participation period is:  

from 6 to 12 months - 0,7;  

from 12 to 24 months - 0,75;  

from 24 to 36 months - 0,85;  

from 36 to 48 months - 0,9;  

from 48 to 60 months - 0,95;  

from 60 to 72 months - 1,0;  

from 60 months or more - 1,0 + 2 percent for every 12 months of participation in the CSIS (or + full years * 0,02).

Example:

Let's say a member of the compulsory social insurance system with 85 months of participation within 2 years before registering as unemployed: 

the first year salary - 150 000 tenge (object of calculating SC excluding MPC = 150 000 tenge - 15 000 tenge = 135 000 tenge),  

second year salary - 200 000 tenge (object of calculation of SC minus MPC = 200 000 tenge - 20 000 tenge = 180 000 tenge)).

Incomes for each month are determined on the basis of the SC received by the State Social Insurance Fund from the SC calculation object.  

Amount of income for 24 months: 12 months * 135 000 tenge +12 months * 180 000 tenge = 3 780 000 tenge.  

The amount received is divided by 24: AMI = 3 780 000 tenge / 24 = 157 500 tenge.

Income replacement rate (IRR)=0,4

LP = 1+ ((85 - 60)/12) full years * 0.02 = 1.04

SBjl = AMI * IRR * LP= 157,500 tenge * 0.4 * 1.04 = 65,520 tenge

Of the specified amount, 10% of the MPC 6 992 tenge is withheld and transferred to the beneficiary's account in the Unified Accumulative Pension Fund. 

The beneficiary's bank account will be credited with SBjl = 65 520 tenge - 6 552 tenge = 58 968 tenge on a monthly basis.

With more than 60 months of experience, the SBjl is assigned for 6 months.

9. In what cases is the social benefit in case of job loss (SBjl) suspended?

In the case of receipt of information from information systems of state bodies and organizations, the decision to suspend SBjl from the first day of the month following the month of receipt of information is made:

1) departure of the recipient for permanent residence outside the Republic of Kazakhstan;

2) Expiry of the document certifying the identity of the foreigner or stateless person, the certificate of kandas

3) on revealing the fact of missing persons being on the wanted list;

4) about the serving by the recipient of a criminal sentence imposed by the court in the form of deprivation of liberty;

5) on revealing the fact of ceasing of citizenship of the Republic of Kazakhstan prior to obtaining a permanent residence permit on the territory of the Republic of Kazakhstan;

6) on identification of the fact of termination of citizenship of the Republic of Kazakhstan prior to obtaining a residence permit for a foreigner;

7) on de-registration at the permanent place of residence of the beneficiary (SBjl) in connection with departure for permanent residence outside the Republic of Kazakhstan

8) on deceased or declared deceased;

9) from authorized bodies and organizations, as well as from a payer of social charges about the applicant's provision of false information resulting in an unreasonable determination of the amount of the SBjl.

10. When is the social benefit in case of job loss (SBjl) renewed?

In the case of circumstances that constitute grounds for renewal, the LTCP is renewed from the date of suspension or from the date the right to renewal occurs.

11.When does the social benefit in case of job loss (SBjl) end?

The SBjl  is terminated from the first day of the month following the month in which the circumstance which is the basis for such termination occurred, in case of receipt of information from information systems of state bodies and organizations:

1) about death of a recipient (recognition by court as missing or declared dead). Thus the social payment is carried out till the month of death of the recipient (from the date of entry into legal force of court decision on recognition as missing or declaration as dead) inclusive;

2) the recipient has provided unreliable documents (information), which served as a basis for making a decision on the assignment of social payment. In this case social payment is terminated from the date of its appointment;

3) in connection with submission of the recipient's application for termination of social payment. In this case, social payment shall be terminated from the first day of the month following the month of application;

4) on removal of the recipient from the registration as unemployed in the employment center. In this case, social payment is terminated from the first day of the month following the month in which the recipient was de-registered as unemployed;

5) from the date of achievement by the recipient of age provided by item 1 of article 11 of the Law of the Republic of Kazakhstan "About pension provision in the Republic of Kazakhstan": men - 63 years, women - 60 years 6 months in 2022 (annually pension age for women is increased by 6 months, in 2027 - 63 years).

12. Is the social benefit in case of job loss (SBjl) terminated if the unemployed person is involved in active employment promotion measures?

In cases where an unemployed person is sent by the employment center to social jobs, public works and vocational training, the SBjl does not stop.

13. How is a social payment in case of job loss (SBjl) assigned if a citizen has re-registered as unemployed?

The SBjl upon subsequent application is assigned based on the fact that for each month of the previously received SBjl, 12 months are deducted from the total experience of participation in the system of compulsory social insurance. This affects the determination of the term for assigning an SBjl when applying for a SBjl again, as well as the size of the SBjl.

Example:

During the initial application for the SBjl, the employee had a total participation period of 124 months, and he was assigned a SBjl for 6 months. If he did not get a job during the specified period and received a SBjl, then upon re-registration as an unemployed person and subsequent application for another SBjl, (6 months * 12 months) = 72 months will be deducted from his total length of service. 

Thus, the experience of participation for the next appointment of the SBjl will be (124 months - 72 months) = 52 months. 

Accordingly, the next SBjl will be appointed for 5 months.
