Answers to questions on social benefits in case of disability (SBd) from the State Social Insurance Fund

1. Is there a standard for the provision of public services for the appointment of social benefits in case of disability?

The public service standard "Assignment of social benefits in case of disability" is approved by Appendix 6 to the Rules for calculating (determining), the amount of social benefits, assigning, recalculating, suspending, resuming, terminating and making social benefits from the State Social Insurance Fund and their implementation, approved by order of Minister of Labor and Social Protection of the Population of the Republic of Kazakhstan dated June 8, 2020 No. 217.

2. When does the right to assign a social benefit in case of disability (SBd) arise?

The right to appoint SBd arises from the day medical and social expertise unit establishes the degree of loss of general working capacity from 30% to 100% (inclusive) for a participant in the compulsory social insurance system.

3. Is a social benefit in case of disability (SBd) assigned if a citizen continues to work?

According to paragraph 1 of Article 20 of the Law of the Republic of Kazakhstan "On Compulsory Social Insurance", SBd is assigned to a participant in the compulsory social insurance system, regardless of whether work has been terminated by the time of applying for the assignment of social benefits or continues. Thus, the recipient of the SBd can work and earn income.

4. For what period is the social benefit in case of disability (SBd) assigned?

SBd is appointed from the day medical and social examination determines the degree of loss of general ability to work (GD) for the entire established period of the GD, but no further than the generally established retirement age: men - 63 years, women - 60 years 6 months in 2022 (the retirement age for women increases annually for 6 months, in 2027 - 63 years).

In the event of a change in the degree of GD, SBd is determined in the amount corresponding to the newly established degree of GD from the day the degree of GD was changed.

5. What documents are needed to assign a social benefit in case of disability (SBd)?

SBd is appointed on the basis of the following documents: 

1) identity document (identity card, stateless person's card, residence permit of a foreigner) or repatriate (qandas) certificate for persons with qandas status - required for identification;

2) for residents of the city Baikonur - a certificate from the department of accounting and registration of citizens for housing sector of Baikonur;

The specialist who receives the application and documents, generates requests to the relevant IS through the e-government gateway:

1) in the IS State database "Individuals" on the documents proving the identity of the applicant;

2) in the IS of second-tier banks according to information about the number of a bank account opened with banks and (or) organizations carrying out certain types of banking operations, or a cash control account of a correctional institution;

3) in the IS "Centralized Data Bank of Persons with Disabilities" on certificates on establishing the degree of loss of general ability to work, on conducting an examination and establishing a disability group.

In case of inconsistency (absence) of information in the IS, the relevant documents are attached to the application, with the exception of information about the bank account number.

6. Where is an application for the appointment of a social benefit in case of disability (SBd)?

One must apply with an identity document and a statement:

1) through the subdivision of medical and social expertise (MSE) - during the initial determination of the degree of loss of general ability to work (GD);

2) through the State Corporation "Government for Citizens" in the presence of information on the degree of GD at the time of application.

In this case, the service recipient submits an application on the principle of "one application": 

at the location of MSE subdivision of the corresponding region;

at field meetings:

on the basis of medical institutions at the place of permanent residence (registration) of the service recipient;

at the place of stay for treatment in specialized institutions;

in correctional institutions and pre-trial detention centers, at the place of residence of the service recipient;

at home, in a hospital - if a person, for health reasons, in accordance with the conclusion of the medical advisory commission, cannot appear at the MSE;

in absentia - when the examined person is not transportable and / or is on inpatient treatment outside the served region, with the consent of the examined person or legal representative; 

3) when registering the telephone number of the service recipient on the e-government portal, a proactive service is provided, if the consent of the service recipient is received within 3 calendar days by text notification.

7. During what time is the social benefit in case of disability (SBb) assigned?

The term for the appointment of SBd does not exceed eight working days from the date of registration of the application with all the necessary documents to the State Corporation "Government for Citizens" (hereinafter - State Corporation) or from the date of receipt of consent to the appointment of SBd through a proactive service by text notification from the applicant's mobile subscriber device.

The State Social Insurance Fund (SSIF) has the right to verify the authenticity of documents (information) necessary for the assignment of social benefits. For these purposes, the SSIF, within 4 working days, requests information in the information systems of state bodies and relevant organizations, the payer of social contributions. At the same time, the applicant is notified in writing by the branch of the State Corporation about the delay in making a decision on the appointment of a SBd and the deadlines for extending the decision, but not more than one month, from the date the electronic layout of the case was sent for verification. 

The branch of the State Corporation, within 5 working days from the date of receipt of an electronic notification from the State Social Insurance Fund, notifies the applicant:

upon personal application of the applicant by delivery of documents verification notice.

if there is a mobile phone number in the information system by sending a text notification to the applicant's mobile phone.

8. How is the amount of social benefit in case of disability (SBd) determined?

SBd=(AMI-55% of MW)*IRR*LP*DR, where:

AMI - the average monthly income of a participant in the system of compulsory social insurance for the last 24 months preceding the month of determining the degree of loss of general working capacity (GD),     

AMI=(MI1+MI2+MI3...+MI24)/24, where:     

MI - monthly income taken into account as an object of calculation of social contributions (hereinafter - SC)(income minus income from which SC are not paid, including mandatory pension contributions (hereinafter - MPC)).

MW - the amount of the minimum wage established by the law on the republican budget on the date of the emergence of the right for SBd;   

IRR - income replacement rate is 0.6;   

DR - the coefficient of disability corresponds to the established degree of GD from 30% to 100% (inclusive).   

LP- length of participation : 

less than 6 months - 0,1; 

from 6 to 12 months - 0,7; 

from 12 to 24 months - 0,75; 

from 24 to 36 months - 0,85; 

from 36 to 48 months - 0,9; 

from 48 to 60 months - 0,95; 

from 60 to 72 months - 1,0; 

from 60 months or more - 1,0 + 2 percent for every 12 months of participation in the CSIS (or + full years * 0,02).

Example

Let's say that a member of the system with 85 months of participation and a 90% degree of GD within 2 years before the date of establishment of the GD degree:

the first year salary - 150 000 tenge (object of calculating SC excluding MPC = 150 000 tenge - 15 000 tenge = 135 000 tenge)

second year salary - 200 000 tenge (object of calculation of SC minus MPC = 200 000 tenge - 20 000 tenge = 180 000 tenge).

Incomes for each month are determined on the basis of the SC received by the State Social Insurance Fund from the SC calculation object. 

Amount of income for 24 months: 12 months * 135 000 tenge +12 months * 180 000 tenge = 3 780 000 tenge. 

The amount received is divided by 24: AMI = 3 780 000 tenge / 24 = 157 500 tenge

DR=0,9

IRR=0,6

LP =1+((85 months - 60 months)/12) full years * 0,02 = 1,04;


 SBd = (AMI - 55% * MW) * DR * IRR * LP =

(157 500 tenge - 55% * 60 000 tenge) * 0,9 * 0,6 * 1,04 = 69 920 tenge.

Of the specified amount, 10% of the MPC 6 992 tenge is withheld and transferred to the beneficiary's account in the Unified Accumulative Pension Fund. In the event that the recipient is a person with a indefinite disability, the MPC are withheld based on his/her consent.

The beneficiary's bank account will be credited with SBd = 69 920 tenge - 6 992 tenge = 62 928 tenge on a monthly basis. 

As of 01.01.2022 MW = 60 000 tenge.

9. In what cases is the social benefit in case of disability (SBd) suspended?

In case of receipt of information from the information systems of state bodies and organizations, a decision is made to suspend the SBd from the first day of the month following the month of receipt of information:
1) on the departure of the recipient for a permanent place of residence outside the Republic of Kazakhstan;

2) on serving by the recipient of a criminal sentence imposed by a court in the form of deprivation of liberty;

3) on the expiration of the validity period of the document proving the identity of a foreigner or a stateless person, a repatriate (qandas) certificate;

4) on revealing the fact of missing persons who are wanted;

5) on the identification of facts, including from information systems, of the recipient's termination of citizenship of the Republic of Kazakhstan on the grounds provided for  by the Law of the Republic of Kazakhstan "On Citizenship of the Republic of Kazakhstan", prior to obtaining a permit for permanent residence in the territory of the Republic of Kazakhstan;

6) on removal from registration at the permanent residence place of the social benefits recipient in connection with the departure for permanent residence outside the Republic of Kazakhstan;

7) about the deceased or declared deceased;

8) on revealing the facts of termination of citizenship of the Republic of Kazakhstan prior to obtaining a permit for permanent residence on the territory of the Republic of Kazakhstan;

9) about revealing the fact of termination of citizenship of the Republic of Kazakhstan before obtaining a residence permit of a foreigner;

10) from authorized bodies and organizations, as well as from the payer of social contributions about the provision by the applicant of false information, which entailed an unreasonable determination of the amount of SBd;

11) from the date of the end of the established period of loss of general working capacity (GD) of the recipient until the establishment of the next period of GD.

10. How is the social benefit in case of disability (SBd) renewed for persons who left for permanent residence outside the Republic of Kazakhstan and returned?

In case of non-receipt of benefits in the country of departure, the SBd is renewed from the date of termination of the SBd, but not more than three years before applying for their receipt on the basis of the documents provided for by the relevant standards of public services.

At the same time, SBd is renewed in the amount established at the time of departure from the Republic of Kazakhstan. If during the period of departure an increase in SBd took place, their amount is set, according to these increases. 

In case of receiving benefits in the country of departure, the SBd is renewed from the date of application, subject to registration at a permanent place of residence in the Republic of Kazakhstan in the amount established at the time of departure outside the Republic of Kazakhstan on the basis of documents provided for by the relevant standards of public services.

11. When does the social benefit in case of disability (SBd) stop?

SBd is terminated from the first day of the month following the month in which the circumstance that is the basis for such termination occurred, in case of receipt of information from the information systems of state bodies and organizations:

1) on the recipient's death (declaration by the court as missing or declared deceased). In this case, the social benefit is made up to the month of death of the recipient (from the date of entry into force of the court decision on recognition as missing or declared deceased) inclusive;

2) on the provision by the recipient of false documents (information) that served as the basis for making a decision on the appointment of a social benefit. In this case, the social benefits is terminated from the date of its appointment;

3) in connection with the submission of the recipient's application to terminate the social benefit. In this case, the social benefit is terminated from the first day of the month following the month in which the application was submitted;

4) from the day the recipient reaches the age specified  in paragraph 1  of Article 11 of the Law of the Republic of Kazakhstan "On Pension Provision in the Republic of Kazakhstan" - men - 63 years, women - 60 years 6 months in 2022 (annually the retirement age for women increases by 6 months, in 2027 - 63 years);

5) from the day the decision is made by the division of medical and social expertise on recognizing the recipient as able-bodied.

12. In what cases does the recalculation of the social benefit in case of disability (SBb) take place?

The recalculation of the social benefit amount in the event of a change in the degree of loss of general ability to work (GD), the period for establishing the degree of GD is made on the basis of information received from the information system of the Ministry of Labor and Social Protection of the Population of the RK.

In the event of the next re-examination by a medical and social examination and the establishment of the degree of GD, the SBd is renewed in the amount established at the time of suspension.

If six months or more have passed from the end date of the previous term for establishing the degree of GD, the application for recalculation of the SBd is accepted by the branch of the State Corporation "Government for Citizens".

The new SBd is calculated by dividing the current SBd by the current DR and multiplying the result by the newly established DR.

Example

SBd amount = 60 000 tenge at DR = 0,5 (50% GD)

In case of GD increase up to 70%, DR = 0,7 , then

New amount of SBd = SBd/0,5*0,7 = 60 000 tenge / 0,5*0,7 = 84 000 tenge

13. Are social disability benefits (SBd) increased on an annual basis?

Annually, as of January 1 of the current year, the SBd increase in the amount provided for by the Decree of the Government of the Republic of Kazakhstan.
