Answers to questions on the social benefit in case of loss of a breadwinner (SBlb) from the SSIF

1. Is there a standard for the provision of public services for the assignment of social benefits for the loss of a breadwinner?

The public service standard "Assignment of social benefits in case of loss of a breadwinner" is approved by Appendix 7 to the Rules for calculating (determining), the amount of social benefits, assigning, recalculating, suspending, resuming, terminating and making social benefits from the State Social Insurance Fund and their implementation, approved by order Minister of Labor and Social Protection of Population of the Republic of Kazakhstan dated June 8, 2020 No. 217.

2. When does the right to assign a social benefit in case of loss of a breadwinner arise (SBlb)?

The right to assign a social benefit in case of loss of a breadwinner arises from the date of death indicated in the death certificate, or from the date the court decision on declaring a citizen participating in the compulsory social insurance system as deceased comes into force, or from the date indicated in the court decision on recognition him missing or being declared dead.

3. Who is entitled to a social benefit in case of loss of a breadwinner (SBlb)?

The following family members who were dependents of the deceased (recognized by the court as missing or declared dead) breadwinner who is a participant in the compulsory social insurance system have the right to appoint and receive a social payment in case of loss:

1) children including adopted, brothers, sisters and grandchildren, not reached the age of eighteen and over that age if they became disabled before reaching the age of eighteen

At the same time, brothers, sisters and grandchildren - provided that they do not employable parents or if they do not receive alimony from their parents. The specified persons above eighteen years of age, studying or studying on a full-time general secondary, technical and vocational, post-secondary education, higher and (or) postgraduate education, have the right to assignment and receipt of social benefits until graduation, but no more than until the age of 23;

2) one of the parents or spouse, or grandfather, grandmother, brother or sister, independent from the age and employability, if he (she) is busy looking after the children, brothers, sisters or grandchildren of deceased wage earner (recognized by the court as missing), not reached the age of 3;

4. Who is assigned a social benefit in case of loss of a breadwinner (SBlb)?

For all family members who were dependents of the deceased (recognized by the court as missing or  declared dead) breadwinner, who are entitled to the appointment and receipt of the SBlb, one social payment is assigned.

5. How is the allocation of a share to one of the recipients of the social benefit in case of loss of a breadwinner (SBlb)?

Upon a written application of a family member who was dependent on the deceased (recognized by the court as missing or declared dead) breadwinner, his share of the SBlb is allocated and paid to him separately.

The allocation of the share of social benefits is made from the date of application to the SSIF.

6. For what period is the social benefit in case of loss of a breadwinner (SBlb) assigned to persons recognized as disabled since childhood of the first or second group?

For persons recognized as disabled from childhood of the first or second group(SBlb) are assigned for the period of establishing disability.

7. How is the social benefit in case of loss of a breadwinner (SBlb) assigned if children have lost both parents?

In the case of loss of both parents - participants in the system of compulsory social insurance (SBlb) are paid to the adoptive parent, guardian for each lost parent.

8. How long does it take to apply for social benefit in case of loss of a breadwinner (SBlb)?

The period of applying for social benefits for the loss of the breadwinner cannot exceed the period of reaching the age of twenty-three years for children, including adopted children, brothers, sisters and grandchildren, who were dependent on the deceased (recognized by the court as missing or declared dead) breadwinner, on the date of application for social benefits, except for persons who became disabled before reaching the age of eighteen years.

9. What documents are needed for the assignment of social benefits in case of loss of a breadwinner (SBlb)?

SBlb are assigned on the basis of the following documents:

- an identity document (identity document, certification of stateless persons, foreigner’s residence permit) or a Kandas certificate for persons with the status of kandas (required for identity identification);

- for residents of the city of Baikonur – reference of the Department for accounting and registration of citizens of housing in the city of Baikonur;

- a death certificate of the breadwinner or a court decision declaring the person missing or declared dead;

- documents confirming family relations with the deceased (recognized by the court as missing or declared dead), birth certificates of the child (children) of the deceased breadwinner and on the conclusion (dissolution) of marriage (matrimony), on adoption, on establishing paternity (maternity)

- certificates from the organization of secondary, technical and vocational, post-secondary, higher and (or) postgraduate education that family members aged eighteen to twenty-three years are students or full-time students (updated annually);

- the document confirming the establishment of guardianship.

Specialist receiving the application and documents forms requests to the appropriate information systems (IS) through the gateway "e-government":

- in the IS State Database " Individuals" by documents certifying the identity of the applicant;

- in the IS of second-tier banks according to the information about the number of the bank account opened in banks and (or) organizations implementing certain types of banking operations, or the control cash account of the correctional institution;

- in the IS "CR" on the birth certificate of the child (children) or a certificate containing information from the civil status records on birth, on the adoption of the child (children), on marriage or a certificate containing information from the civil status records about marriage, about the death of the breadwinner (recognized by the court as missing or declared dead) about the death of the child (children) or a certificate containing information from the civil status records about death;

- in IS "NED" according to information about full-time education of dependents in organizations of general secondary education, technical, vocational, post-secondary, higher, postgraduate education;

- in the IS "Centralized Data Bank of Persons with Disabilities" on the examination and establishment of a disability group (in the case when children, including adopted (adopted) brothers, sisters and grandchildren under the age of eighteen and older than this age, are recognized as disabled from childhood of the first or second group);

in IS "e-Custodianship" on the certificate of establishment of guardianship on the establishment of guardianship over the child

In case of inconsistency (absence) of information in the IS, the relevant documents are attached to the application, with the exception of information about the bank account number.

10. Where to apply for a social benefit in case of loss of a breadwinner (SBlb)?

You must apply with an identity document and a statement:

- through the State Corporation "Government for Citizens" (hereinafter - the State Corporation);

or

- when registering a subscriber device of a cellular communication of a service recipient on the e-government portal, a proactive service is provided, if the consent of the service recipient is received within 3 calendar days by SMS notification.

A person entitled to a share of the (SBlb) applies to a branch of the State Corporation.

11. How long is a social benefit in case of loss of a breadwinner assigned (SBlb)?

The term for assigning a (SBlb) does not exceed eight working days from the date of registration of an application with all the necessary documents at the State Corporation "Government for Citizens" (hereinafter - the State Corporation) or from the date of receipt of consent to the assignment of a (SBlb) through a proactive service by SMS notification from the subscriber's mobile device of the applicant.

The State Social Insurance Fund (SSIF) has the right to verify the authenticity of documents (information) necessary for the assignment of social benefits. For these purposes, the SSIF, within 4 working days, requests information in the information systems of state bodies and relevant organizations, the payer of social contributions. At the same time, the applicant is notified in writing by the department of the State Corporation about the delay in making a decision on the appointment of a (SBlb) and the deadlines for extending the decision, but not more than one month, from the date the electronic layout of the case was sent for verification. 

The branch of the State Corporation, within 5 working days from the date of receipt of an electronic notification from the SSIF, informs the applicant:

- upon personal application of the applicant by delivery of a notice of verification of documents;

- if there is a mobile phone number in the information system by sending an SMS notification to the applicant's mobile phone.

12. How the amount of social payment in case of loss of a breadwinner is determined (SBlb)?

The amount of monthly (SBlb) is determined by the formula:

СВпк = (СМД - 50% от МЗП) * КЗД * КСУ * ККИ, где:

AMI – average monthly income of a participant in the compulsory social insurance system for the last 24 months preceding the month of death of the breadwinner:

AMI = (MI 1+ MI 2+MI 3.......+ MI 24) / 24, where:

MI - monthly income, accounted for as an object of calculation of social contributions (hereinafter – SC) (income minus income from which social contributions are not paid, including compulsory pension contributions).

MW – the amount of the minimum wage established by the law on the republican budget on the date of the emergence of the right to (SBlb);

IRR – income replacement ratio is 0.6;

DR – dependency ratio is:

with one dependent – 0.5,

with two dependents - 0.65,

with three dependents - 0.8,

with four or more dependents - 1.0;

LP – length of participation is:

less than 6 months - 0.1;

from 6 to 12 months - 0.7;

from 12 to 24 months - 0.75;

from 24 to 36 months - 0.85;

from 36 to 48 months - 0.9;

from 48 to 60 months - 0.95;

from 60 to 72 months - 1.0;

from 60 months or more - to 1.0 + 2 percent for every 12 months of participation in the CSIS (or + full years * 0.02).

Example

Suppose a system member with 85 months of participation and three dependents within 2 years prior to the date of death: 

The first year's salary - 150 000 tenge (the object of the calculation of SC minus MPC = 150 000 tenge - 15 000 tenge = 135 000 tenge),

Second year salary - 200 000 tenge (the object of SC calculation minus MPC = 200 000 tenge - 20 000 tenge = 180 000 tenge).

Income for each month is determined on the basis of the received SC to the State Social Insurance Fund from the object of SC calculation.  

The amount of income for 2 years: 12 months. * 135 000 KZT + 12 months. * 180 000 tenge = 3 780 000 tenge. 

The resulting amount is divided by 24: AMI = 3 780 000 tenge / 24 = 157 500 tenge.

DR = 0.8

IRR = 0.6

LP = 1+ ((85 mon. – 60 mon.) / 12) * 0.02 = 1.04

СВпк = (СМД - 50% * МЗП) * ККИ * КЗД * КСУ =

(157 500 тенге - 50% * 70 000 тенге) * 0,8 * 0,6 * 1,04 = 61 152 тенге.

На банковский счет получателя будет перечисляться СВпк – 61 152 тенге на ежемесячной основе.

С 01.01.2023 г. МЗП – 70 000 тенге. 

13. In what cases is the recalculation of the social benefit in case of loss of the breadwinner (SBlb) made?

In the event of a change in the number of family members who were dependent on the deceased (recognized by the court as missing or declared dead) breadwinner, the SSIF decides on the recalculation of social benefits. At the same time, the size of the SBlb increases or decreases, respectively, according to the number of family members eligible to receive the SBlb.

14. How is the recalculation of the social benefit in case of loss of the breadwinner (SBlb) carried out in case of an increase in the number of dependents?

In the event of an increase in the number of dependents, the recalculation of the amount of the SBlb is made on the basis of a written application by the recipient of the social payment, a family member who was dependent on the deceased (recognized by the court as missing or declared dead) breadwinner:

- from the date of the beginning of the period of study, when providing a certificate from the organization of secondary, technical and vocational, post-secondary higher education and (or) postgraduate;

- from the date of the death of the breadwinner (but not earlier than the date of birth of the child, in case of his birth after the death of the breadwinner), if the recipient of the social payment of a family member who was dependent on the deceased (recognized by the court as missing or declared dead) breadwinner was included in the list of dependents.

The new amount of the SBlb is calculated by dividing the current amount of the SBlb by the current dependency ratio (hereinafter - DR) and multiplying the result by the newly established DR.

Example

The size of the SBlb is 60,000 tenge for 3 dependents with a DR = 0.8.

One of the full-time dependents has reached the age of 23.

The recalculation for 2 dependents with DR = 0.65 is made as follows:

The new size of the SBlb = 60,000 tenge / 0.8 * 0.65 = 48,750 tenge.

15. How is the recalculation of the social benefit in case of loss of the breadwinner (SBlb) in case of a decrease in the number of dependents?

The recalculation of the size of the SBlb in the event of a decrease in the number of dependents is carried out in the event that information is received from the information system of the IS "CR".

In the absence of information from the information system IS " CR ", in the event of a decrease in the number of dependents, the recalculation of the amount of the SBlb is carried out from the date of termination of the SBlb to one of the dependents of the deceased (recognized by the court as missing or declared dead) breadwinner on the basis of the application of the recipient of the SBlb for recalculation of the amount of the SBlb.

The new SBlb is calculated by dividing the current SBlb by the current dependency ratio and multiplying the result by the newly established dependency ratio.

16. In what cases is the social benefit for the loss of a breadwinner suspended?

In case of receipt of information from the information systems of state bodies and organizations, a decision is made to suspend the SBlb from the first day of the month following the month of receipt of information:

1) on the departure of the recipient for a permanent residence outside the Republic of Kazakhstan;

2) on the expiration of the document proving the identity of a foreigner or a stateless person, a Kandas certificate;

on revealing the fact of missing persons who are wanted;

4) on revealing the facts of termination of citizenship of the Republic of Kazakhstan before obtaining a permit for permanent residence in the territory of the Republic of Kazakhstan;;

5) on revealing the fact of termination of the citizenship of the Republic of Kazakhstan before obtaining a residence permit of a foreigner;;

on serving by the recipient of a criminal sentence imposed by the court in the form of deprivation of liberty;

7) on revealing the facts of deprivation of parental rights of a parent and the rights of a guardian (custodians, foster caregivers, adoptive parents) on released and suspended guardians (custodians, foster caregivers, adoptive parents);

8) on deregistration at the permanent place of residence of the recipient of the SVPC in connection with the departure for permanent residence outside the Republic of Kazakhstan;

9) on revealing the fact of transferring compulsory pension contributions (compulsory occupational pension contributions) to individual pension accounts of persons declared missing or declared dead, or receipt of information confirming the fact that the citizen is alive;

10) on the expiration of the period for establishing a disability for persons declared disabled from childhood of the first or second group, who were dependent on the deceased (declared by a court to be missing or deceased) breadwinner, prior to re-evaluation;

11) on the expiration of the certificate issued by the organization of secondary, technical and professional, post-secondary, higher and (or) postgraduate education, that family members of the deceased (recognized by the court as missing or declared dead) breadwinner are students or full-time students;

on expulsion of the recipient and (or) a dependent of the SBlb over 18 years from the educational organization or on its transfer to the correspondence form of education;

about the dead or declared dead;

14) from authorized bodies and organizations, as well as from the payer of social contributions about the provision by the applicant of false information, which entailed an unreasonable determination of the amount of the SBlb.

17. How does the social benefits for loss of breadwinner resume for students and for students studying on a full-time basis?

Upon submission of a certificate from an organization of secondary, technical and vocational, post-secondary, higher and (or) postgraduate education that family members are full-time pupils or students (hereinafter - the Certificate), SBlb is renewed on the basis of a written application from the moment of suspension, but not earlier than the start date of the study period specified in the Certificate.

18. How is the social benefit in case of loss of a breadwinner (SBlb) renewed for persons recognized as disabled from childhood of the first or second group?

In case of re-examination of persons recognized as disabled from childhood of the first or second group, who were dependent on the deceased (recognized by the court as missing or declared dead) breadwinner, the SBlb is resumed from the date of re-examination.

19. When does the social benefit for the loss of a breadwinner (SBlb) stop?

The SBlb is terminated from the first day of the month following the month in which the circumstance that is the basis for such termination occurred, in case of receipt of information from the information systems of state bodies and organizations:

1) on the death of the recipient (by recognition by the court as missing or declared dead). In this case, the social payment is made up to the month of death of the recipient (from the date of entry into force of the court decision on recognition as missing or declared dead) inclusive;

2) on the provision by the recipient of false documents (information) that served as the basis for making a decision on the appointment of a social payment. In this case, the social payment is terminated from the date of its appointment;

3) in connection with the application of the recipient for the termination of social benefits. In this case, the social payment is terminated from the first day of the month following the month in which the application was submitted;

4) in connection with the death of a person who was dependent on the deceased (recognized by the court as missing or declared dead) breadwinner, and is carried out up to the month of death inclusive;

5) in connection with the expulsion of the recipient (dependent) over 18 years of age from an educational organization or his transfer to correspondence form of education and terminates from the first day of the month following the month of receipt of information about the expulsion of the recipient (dependent) or transfer to correspondence form of education, including from information systems;

6) from the date of expiration of the term for establishing the disability of a person who was dependent on the deceased (recognized by the court as missing or declared dead) breadwinner;

7) from the day the person who was dependent on the deceased (recognized by the court as missing or declared dead) the breadwinner reaches 18 years of age (with the exception of persons who became disabled before reaching the age of eighteen), and in the case of training of the specified person in full-time education in general organizations secondary, technical and vocational, post-secondary, higher and (or) postgraduate education - 23 years of age.

20. Does the amount of social benefits for the loss of a breadwinner (SBlb) increase on an annual basis?

Annually, recipients  of SBlb as of January 1 of the current year is increased   increased the amount of SBlb in the amount stipulated by the Government of the Republic of Kazakhstan.
